DHS/ICE did state in a Jan. 20, 2026 DHS press release that “ICE has more than 1,360 arrest detainers for the criminal illegal aliens in their custody.” However the underlying fact is inaccurate as written: the agencies’ own statements and Minnesota officials say the 1,360 figure refers to ICE arrest detainers placed on people held in Minnesota state/local jails — not immigrants already in ICE custody. Minnesota officials (Minnesota DOC and state spokespeople) disputed DHS’s characterization and said those individuals are in state custody, and ICE publicly describes detainers as requests to state/local jails to hold individuals for transfer to ICE rather than persons already in ICE custody. Verdict: False — the quoted sentence misstates the status of the people (they are not “in ICE custody”) and conflates ICE detainers with ICE custody.
